Terms of Service

VidCortex generates marketing videos for Shopify merchants using AI services. You are responsible for the content you submit and publish.

Specialized Technology: VidCortex is engineered specifically for the fashion industry. Our AI algorithms are optimized to analyze and animate clothing, fabric textures, and human models.

Non-Apparel Disclaimer: While the Service does not technically restrict the upload of non-apparel images (e.g., electronics, furniture, automotive, food), you acknowledge that results for these categories are not guaranteed and may be distorted or visually incoherent.

No Refunds for Misuse: We do not offer refunds or credit restorations for failed or unsatisfactory generations resulting from the use of non-apparel product images. We strongly recommend using the Free Demo to test suitability for your specific catalog before purchasing a paid plan.

Where available, VidCortex supports model ethnicity and gender customization to better match your brand and audience.

You agree not to use the service for illegal, harmful, or prohibited content, including NSFW content.

Free Demo Users: Content generated under the Free Demo plan is for testing and personal use only. It may contain watermarks and is not licensed for commercial advertising.

Paid Subscribers (Starter, Creator, Brand): Upon purchase of a paid subscription or refill pack, VidCortex grants you a perpetual, non-exclusive, worldwide license to use, display, and distribute the generated video content for commercial purposes, including social media advertising and marketing campaigns. You retain full ownership of the generated media assets.

Support Policy: Support is provided exclusively via email. We aim to respond to Priority Support inquiries (Brand Plan) within 24 hours, and Standard Support inquiries within 48 hours. We do not offer phone or video consultation services.

Merchant Override (Proceed Anyway): If you choose to override an image compliance warning and proceed anyway, you acknowledge that generation may fail or produce low-quality results, including visual artifacts (e.g., distortion) or outputs that do not match the featured image/product identity. You accept full responsibility for this decision. VidCortex does not provide refunds or credits for issues caused by a merchant override.

No Guarantee of Accuracy (Hallucinations): You acknowledge that AI models (including Google Veo) are probabilistic and may produce hallucinations, visual artifacts, or unintended distortions. The generated video may not perfectly reflect the physical attributes (color, texture, materials, logos, sizing, or features) of your uploaded product.

Merchant Review Obligation: You are solely responsible for reviewing all generated content for accuracy, legality, and platform compliance before publishing or advertising. VidCortex is not liable for customer disputes, returns, chargebacks, or legal claims arising from misleading or inaccurate advertisements caused by AI distortions.

Inadvertent Likeness: AI-generated models are synthetic. Any resemblance to real persons (including celebrities or private individuals) is coincidental. If a generated character resembles a public figure or identifiable person, you agree not to use that content for commercial purposes to avoid right of publicity, trademark, or related claims.

Synthetic Models Compliance Notice: Where the Service generates or depicts synthetic human models or likenesses (“Synthetic Models”), you are responsible for ensuring your use complies with applicable laws and platform policies, including advertising rules, consumer protection laws (no deceptive marketing), and any applicable right of publicity, privacy, or biometric requirements. You agree not to imply that a Synthetic Model is a real person or an endorsement by a real person.

Input Warranty: You represent and warrant that you own, control, or have obtained all necessary rights and permissions to upload and use any images, product data, trademarks, and other materials you provide to VidCortex. You agree to indemnify and hold VidCortex harmless from any third-party claims alleging that your inputs infringe intellectual property, privacy, or publicity rights.

AI Music License: Background music generated by our service is licensed for digital media use only (e.g., social media, websites, and online ads). It is not cleared for broadcast (TV/radio) or theatrical release unless you obtain separate rights.

Trend Data: Our Social Trend features may analyze public metadata from social platforms via third-party providers. We do not encourage or facilitate copying protected creative expression. You are responsible for ensuring your ads, prompts, and derivative works do not infringe creators' copyrights or violate platform rules.

Refunds are processed at our sole discretion. Because VidCortex provides non-tangible, irrevocable digital goods (credits), we do not generally issue refunds once credits have been used.

Non-Refundable Failed Generations (Google Veo): VidCortex relies on third-party AI providers (including Google Veo) to perform video generation. Google Veo charges based on request execution, not on successful output. If a generation fails due to AI policy filtering, safety blocks, service instability, or model errors, the provider may still retain the processing fee and does not provide refunds. Therefore, credits used for these failed attempts are strictly non-refundable because the underlying third-party costs are non-recoverable.

Do Not Spam Retry: You agree not to repeatedly click "Retry" in rapid succession. Repeated retries may repeatedly trigger third-party execution fees and consume additional credits even if the output continues to fail.

To the maximum extent permitted by law, VidCortex and its AI providers (including Google and Replicate) provide the service on an “as-is” and “as-available” basis and shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, goodwill, or data, arising from your use of or inability to use the service.

If you purchase a paid plan, billing is handled through Shopify. You can cancel anytime in Shopify. Credits are virtual usage units and are non-transferable.
